Website Terms, Conditions & Disclaimer
Last updated: August 2026
These Website Terms, Conditions & Disclaimer (“Terms”) apply to your use of the MAYA Property website, content, resources, property strategy services and related materials.
In these Terms, “MAYA Property”, “we”, “us” and “our” means the relevant MAYA Property business entity and/or licensed property agent providing the relevant service.
Important: These website Terms do not replace or override any statutory form, appointment, disclosure, agency agreement or other document required under Queensland law. Where a specific agreement or approved form applies to a service, that document will govern the relevant engagement to the extent of any inconsistency.
1. Nature of Our Services
MAYA Property provides property-related services which may include buyer's agent services, property search and acquisition assistance, property research, negotiation assistance, relocation assistance, property strategy sessions, educational resources and general property market information.
The exact services provided to a client will depend on the relevant engagement and appointment.
Where we act as a buyer's agent or property agent, our services are provided subject to the applicable Queensland property legislation, including the Property Occupations Act 2014 (Qld) and applicable regulations.
Queensland law requires licensed property agents to comply with statutory obligations relating to appointments, conduct, conflicts of interest, disclosures and representations concerning property.
2. Property Strategy & The Property Strategy Blueprint
Our Property Strategy Blueprint, strategy sessions, guides, educational content and related resources are designed to help clients clarify their property objectives, circumstances, priorities, constraints and potential acquisition strategy.
They are intended to assist with property decision-making and strategic planning.
They do not constitute a guarantee that a particular property should be purchased, that a particular suburb will outperform another suburb, or that a particular property will increase in value.
A strategy is not a promise of an outcome.
The suitability of any property strategy depends on the individual circumstances of the client, the property, the market and other factors that may change over time.
3. Not Financial Advice
Unless expressly stated otherwise and provided under the appropriate regulatory framework, MAYA Property does not provide financial product advice.
Information provided through our website, social media, Property Strategy Blueprint, strategy sessions or property services should not be interpreted as personal financial advice, investment advice or a recommendation to acquire a particular financial product.
Our property strategy services are focused on property-related considerations, research, planning and decision-making.
You should obtain independent advice from an appropriately qualified professional regarding matters outside the scope of our services, including financial planning, lending, taxation, accounting and legal matters.
A disclaimer does not determine whether a communication constitutes financial advice. The substance and circumstances of the communication are relevant.
4. No Financial Outcome Is Guaranteed
We do not guarantee:
- capital growth;
- rental income;
- rental yield;
- investment returns;
- future property values;
- future market conditions;
- finance approval;
- interest rates;
- borrowing capacity;
- tax outcomes;
- development approval;
- resale value;
- a particular purchasing price; or
- any other financial or investment outcome.
Property markets involve uncertainty and risk.
Past performance is not a guarantee of future performance.
5. Individual Circumstances Matter
Property decisions are highly individual.
Two clients may have similar incomes, deposits, budgets and property preferences but require completely different strategies because of differences in their objectives, family circumstances, risk tolerance, timing, financing, intended use of the property and long-term plans.
Any strategy or recommendation provided by MAYA Property should therefore be considered in the context of the client's individual circumstances and the scope of the services actually engaged.
6. Market Information
We may discuss or publish information relating to:
- property prices;
- market conditions;
- supply and demand;
- rental markets;
- demographics;
- infrastructure;
- planning;
- development;

Such information is provided for general informational purposes.
Market conditions can change rapidly.
Where information has been obtained from third parties, government sources, property databases or other external sources, we do not guarantee that the information is complete, accurate or current.
Where a matter is material to a proposed purchase, you should verify the information through the appropriate source or professional adviser.
7. Property-Specific Information
Property information may include information supplied by sellers, selling agents, property portals, councils, government authorities or other third parties.
We will use reasonable care within the scope of our engagement when researching and assessing property information.
However, clients should not assume that every statement, representation, measurement, approval, feature, use or development possibility has been independently verified unless expressly stated.
Material matters should be independently verified where appropriate.
8. Planning, Zoning & Development Potential
Any reference to:
- zoning;
- overlays;
- subdivision;
- development potential;
- dual living;
- secondary dwellings;
- granny flats;
- extensions;
- renovations;
- future infrastructure;
- permissible uses; or

is subject to applicable planning legislation, local government planning schemes, approvals and site-specific requirements.
MAYA Property does not guarantee that a particular development, subdivision, renovation, secondary dwelling or proposed use will be approved.
Clients should obtain confirmation from the relevant local government authority and, where appropriate, an independent town planner, building consultant, surveyor, engineer or other suitably qualified professional.
9. Due Diligence
MAYA Property's services do not replace independent due diligence.
Depending on the property and circumstances, appropriate due diligence may include:
- building and pest inspections;
- structural assessments;
- survey and boundary verification;
- title searches;
- easement and covenant searches;
- planning and zoning searches;
- flood and bushfire assessments;
- environmental investigations;
- contamination investigations;
- insurance enquiries;
- body corporate records;
- council rates and charges;
- infrastructure searches;
- tenancy information;
- development approvals;
- building approvals;
- electrical and plumbing inspections; and
- other specialist investigations.
The client remains responsible for deciding which investigations are appropriate and for obtaining independent professional advice where required.
10. Legal & Contractual Matters
MAYA Property does not provide legal advice unless separately authorised and appropriately qualified to do so.
Contracts of sale, special conditions, disclosure documents, title matters, easements, covenants, contractual rights and obligations should be reviewed by an appropriately qualified Queensland solicitor or conveyancer.
Clients should obtain independent legal advice before entering into a binding contract where appropriate.
Nothing on this website constitutes legal advice.
11. Finance & Lending
MAYA Property does not guarantee finance approval or any particular lending outcome. Any discussion concerning borrowing capacity, interest rates, deposits, loan structures or lending conditions is general information only unless provided by an appropriately authorised professional.
Clients should obtain independent advice from their mortgage broker, lender or financial adviser.
12. Taxation & Accounting
MAYA Property does not provide taxation or accounting advice.
Property transactions may have taxation consequences, including potential stamp duty, land tax, capital gains tax, income tax, GST or other liabilities depending on the circumstances.
Clients should obtain advice from an appropriately qualified accountant or tax professional.
13. Conflicts of Interest
MAYA Property will comply with applicable Queensland obligations concerning conflicts of duty and interest.
A property agent must not accept or continue an appointment where doing so would place the agent's duty or interests in conflict with the client's interests, subject to the applicable legislation and circumstances.
Where a relevant interest, benefit, commission, relationship or other matter is required to be disclosed under Queensland law, the applicable disclosure will be made in the required manner.
Queensland also provides specific disclosure requirements concerning certain interests and benefits involving property transactions.
14. Third-Party Benefits & Referrals
MAYA Property may, where appropriate, refer clients to independent service providers such as:
- mortgage brokers;
- solicitors;
- conveyancers;
- building and pest inspectors;
- surveyors;
- town planners;
- building consultants;
- accountants; or
- other property-related professionals.
Where a benefit, commission, fee or other interest is required to be disclosed under Queensland law, the relevant disclosure will be provided.
Queensland's disclosure regime specifically addresses benefits or interests involving third parties in property transactions.
A referral does not constitute a guarantee or endorsement of the third party's services.
Clients are responsible for making their own decision about whether to engage any third-party professional.
15. Buyer Agency Appointment
Where MAYA Property acts as a buyer's agent/property agent for a client, the relevant appointment must be documented in accordance with Queensland law.
The Queensland Government's approved Form 6 is used for residential property agent appointments and expressly allows a prospective buyer to be the client.
A completed appointment must be provided to the client before the agent performs property-agent services where required by law.
The appointment documentation will set out the applicable services, fees, charges, commission, expenses and other relevant terms.
The website Terms do not replace that appointment.
16. Fees & Commissions
Any fees, commissions, charges and authorised expenses payable to MAYA Property will be set out in the applicable appointment or service agreement.
Queensland requirements include written disclosure of applicable fees, charges and commission and relevant payment terms.
Where applicable, GST will be identified in accordance with the relevant agreement and legal requirements.
MAYA Property will not represent that a service is free where a fee, commission, benefit or other cost is payable.
17. Property Representations
MAYA Property takes care to ensure that representations made in connection with property are based on information reasonably available to us and within the scope of our role.
Under Queensland's Property Occupations Act 2014, a licensee or real estate salesperson must not make false or misleading representations concerning the sale, letting or exchange of real property. The legislation also specifically addresses representations concerning property value, potential rental income, previous sale information and taxation effects.
Accordingly, no statement on this website should be interpreted as a guarantee of a property's value, rental income, capital growth or future performance.
18. Advertising & Social Media
Our website, advertisements, social media posts, videos, reels, emails and other promotional materials may contain general commentary about property markets and property strategy.
We will seek to ensure that our advertising is not false or misleading.
Property advertising in Queensland is subject to specific legal requirements, and misleading representations about property are prohibited.
Statements expressed as opinions will be presented as opinions and should not be interpreted as guarantees of future outcomes.
Where market data, statistics or forecasts are used, the relevant source and date should be considered where provided.
19. Testimonials & Case Studies
Testimonials and case studies represent the experiences of individual clients and are not guarantees that another client will achieve the same or similar result.
Individual outcomes depend on circumstances including budget, timing, financing, property availability, market conditions and client decisions.
Where an outcome is described, it should not be interpreted as a typical or guaranteed result unless expressly stated and properly substantiated.
20. Property Values & Market Forecasts
Any estimate, opinion or discussion concerning property value, future capital growth, rental return or market direction is an opinion or estimate based on information available at the relevant time unless expressly stated otherwise.
It is not a valuation.
A formal valuation should be obtained from an appropriately qualified valuer where required.
MAYA Property does not guarantee future market performance.

Our website may contain links to third-party websites.
These links are provided for convenience and information only.
MAYA Property does not control and is not responsible for the content, accuracy, availability, security or privacy practices of third-party websites.
Your use of a third-party website is subject to that website's own terms and privacy policy.
22. Intellectual Property
Unless otherwise stated, the content on this website and in MAYA Property resources, including text, photographs, graphics, videos, logos, templates, frameworks, guides and the Property Strategy Blueprint, is owned by or licensed to MAYA Property.

The Blueprint must not be:
- resold;

- used to create a competing product or service
without written permission from MAYA Property.

We may modify, suspend or discontinue any part of the website or its content without notice.
25. Accuracy of Information
We make reasonable efforts to ensure that information published on the website is accurate and current.
However, property markets, laws, regulations, government policies, planning requirements, interest rates and other circumstances can change.
We do not warrant that all information will remain current after publication.
You should verify information that is material to your circumstances before relying upon it.
26. Privacy
Personal information collected through the website will be handled in accordance with our Privacy Policy and applicable Australian privacy legislation.
Our Privacy Policy explains how personal information may be collected, used, stored and disclosed.
27. Consumer Rights
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
Australian consumer law prohibits misleading or deceptive conduct, including in relation to real estate services and property representations.
Where a provision of these Terms is unlawful or unenforceable, that provision will be read down or severed to the extent necessary, without affecting the remaining provisions.
28. Limitation of Liability
To the maximum extent permitted by law, MAYA Property is not liable for loss or damage arising from circumstances outside our reasonable control or from a client's decision to rely upon general information that was not provided as part of a specific professional service.
This may include losses arising from:
- changes in property markets;
- changes in government policy;
- planning changes;
- changes in interest rates;
- changes in lending requirements;
- property availability;
- inaccurate third-party information;
- changes in legislation;
- natural events; or
- decisions made by third parties.
Nothing in these Terms excludes liability that cannot legally be excluded or limits any rights or remedies that cannot legally be limited.
29. No Guarantee
MAYA Property does not guarantee that:
- you will purchase a property;
- a particular property will be available;
- a property will be purchased below a particular price;
- a seller will accept an offer;
- finance will be approved;
- a property will increase in value;
- rental income will be achieved;
- a development proposal will be approved; or
- you will achieve a particular financial result.
Our role is to provide the agreed property services and strategic assistance within the scope of the relevant engagement.

- conducting or authorising appropriate due diligence;
- making the final decision to purchase;
- arranging finance;
- satisfying contractual obligations; and
- ensuring that the proposed purchase is suitable for their circumstances.
A client is never required to purchase a property merely because MAYA Property has identified, inspected or recommended it.
31. No Obligation to Purchase
Where MAYA Property is engaged as a buyer's agent, the client remains responsible for the final decision about whether to proceed with a property.
Our role is to assist with the agreed property search, assessment, negotiation and acquisition process.
We do not have authority to commit a client to a purchase unless that authority has been expressly provided in accordance with the applicable appointment and instructions.
